Outlaw Bulls and Outlaw Partners (“Outlaw Bulls”, “Outlaw”, “we”, “us” or “our”) are committed to safeguarding your privacy. This Privacy Policy describes how we collect, use, share, and protect your personal information when you use www.outlawbulls.com (the “Site”), including any content, functionality, or services offered on or through the Site. It also outlines your rights under the Montana Consumer Data Privacy Act (MCDPA) and other applicable laws. By using our Site, you agree to the practices described in this Privacy Policy.

Personal Data You Provide: We collect personal information only when you directly provide it to us, such as:

Information Collected Automatically: When you interact with our Site, we use cookies and similar technologies to automatically collect certain information about your device and usage, including:

Sensitive Personal Data: We do not intentionally collect sensitive personal information (e.g. social security numbers, health or biometric data) through the Site. Please refrain from submitting such data. If you do provide sensitive data, you consent to our processing of that data in accordance with this policy.
2. How We Use Your Information
We use personal information for the following purposes, in line with the MCDPA’s requirements to limit use to what is adequate, relevant, and reasonably necessary:

Provide and Improve Our Services: To fulfill your requests (e.g., sending newsletters, processing magazine subscriptions, posting events) and to maintain and improve the Site’s content and functionality.

Communications: To send you newsletters, updates, marketing communications, or respond to inquiries, with your consent. You can opt out at any time by using the unsubscribe link or contacting us.

Digital and Email Marketing: To inform you about events, promotions, or new content related to Explore Big Sky via email or SMS (with your opt-in consent), as part of our own marketing efforts.

Analytics and Personalization: To analyze usage of our Site (via Google Analytics) and to personalize content and ads you see. We analyze trends to better understand how users interact with our Site, which helps us improve user experience.

Advertising and Retargeting: To serve and measure online advertisements on our Site and third-party platforms. We use Google Ads (via Google Tag Manager) and the Meta Pixel for retargeting, meaning you might see ads for Outlaw Bulls on other platforms after visiting our Site. This is considered “targeted advertising,” and you have the right to opt out (see Section 6. Your Rights).

Security and Fraud Prevention: To maintain the security of our Site, prevent fraud, detect and fix technical issues, and protect our rights and the rights of our users or others.

We will ask for your consent before using personal data for any purpose beyond those listed above, as required by the MCDPA and other applicable laws.
3. How We Share Your Information
We do not sell your personal data to third parties for monetary consideration, and we do not share it for other valuable consideration without your consent (as “sale” may be defined under certain laws). We also do not share your personal data for third-party targeted advertising purposes unless explicitly described here. We may share information in the following situations, with appropriate safeguards:

Service Providers: We engage trusted third-party service providers to perform functions and provide services to us (for example, payment processors for magazine subscriptions, email delivery services for newsletters, cloud hosting, analytics providers like Google Analytics, advertising partners like Google and Meta for our ad campaigns). These service providers are authorized to use your information only as necessary to provide services on our behalf and are bound by contractual obligations to keep your information confidential.

Business Partners: In certain cases, we partner with other organizations or sponsors to offer events or promotions. We will share personal data with these partners only as needed for the specific service you’ve requested or when you have given consent. Our partners are limited to using personal information solely for fulfilling the requested service.

Legal Requirements: We may disclose your information if required to do so by law or in the good-faith belief that such action is necessary to (i) comply with a legal obligation, such as a court order or subpoena; (ii) protect and defend our rights or property; (iii) act in urgent circumstances to protect the personal safety of users of the Site or the public; or (iv) protect against legal liability.

Business Transfers: If Outlaw Bulls or Outlaw Partners (our parent company) is involved in a merger, acquisition, reorganization, or asset sale, your personal data may be transferred as part of that transaction. We will ensure the confidentiality of any personal data involved in such transactions and provide notice before personal data is transferred and becomes subject to a different privacy policy.

Consent: We will share your personal information with third parties for purposes other than those disclosed in this policy only with your explicit consent. For example, if you agree to let us share your testimonial or story publicly, we will do so only with your permission.
4. Cookies and Tracking Technologies
Cookies: Cookies are small text files placed on your device that help us recognize you on future visits, understand usage patterns, and improve our Site and services. We use cookies for:

We obtain your consent for non-essential cookies (like advertising and analytics cookies) where required by law. You can manage or withdraw your cookie consent at any time via our Cookie Preference Center or by adjusting your browser settings to refuse certain cookies. Note, however, that if you disable cookies, some parts of the Site may not function properly.
Other Tracking Technologies: In addition to cookies, we use pixel tags (tiny graphic images embedded in emails or on the Site) and browser local storage to gain insight into site usage and campaign effectiveness. For example, the Meta Pixel is a piece of code on our Site that helps us track conversions from Facebook/Instagram ads, optimize ads, build targeted audiences, and remarket to people who have taken action on our Site.
Do-Not-Track Signals and Global Privacy Control: The MCDPA requires recognizing universal opt-out mechanisms by January 1, 2025. Our Site responds to “Do Not Track” (DNT) signals and Global Privacy Control (GPC) signals to the extent required by applicable law. If your browser or device sends a DNT or GPC signal, we will treat it as a valid opt-out of targeted advertising cookies and any sale of personal data as defined by law.

5. Your Rights and Choices (Montana Consumer Data Privacy Act)
If you are a Montana resident, you have specific rights under the MCDPA regarding your personal data. We extend the same courtesy to all our users where feasible. These rights include:

Right to Access: You can request confirmation of whether we are processing your personal data and, if so, receive access to that data. We will provide a copy of your personal data in a portable and readily usable format, to the extent required by law.

Right to Correct: You can request that we correct inaccuracies in the personal data we hold about you.

Right to Delete: You can request deletion of personal data that you have provided to us or that we have collected about you, subject to certain exceptions (e.g., if we must retain data to comply with legal obligations or for legitimate internal purposes).

Right to Data Portability: You have the right to obtain a copy of personal data you provided to us, in a format that allows you to transfer it to another service provider (to the extent technically feasible).

Right to Opt-Out of Targeted Advertising: You can opt out of the processing of your personal data for targeted advertising purposes. This includes data processed via cookies and tracking for personalized ads. See Section 4. Cookies and Tracking for how to opt out (e.g., through cookie settings or browser signals).

Right to Opt-Out of Sales: You can opt out of any “sale” of your personal data (as defined under MCDPA or applicable law), although as noted, we do not sell personal data in the traditional sense.

Right to Opt-Out of Profiling: You can opt out of profiling based on your personal data if it is in furtherance of decisions that produce legal or similarly significant effects (“automated decision-making”). We do not currently engage in this type of profiling.

Right to Appeal: If we decline to take action on a rights request, you have the right to appeal our decision. We will provide information on how to appeal in our response to your request, including a method to contact the Montana Attorney General if you have concerns about the result of an appeal, as required by law.
Exercising Your Rights: You may exercise these rights by contacting us via any of the methods below in Section 11. Contact Information. We have established two or more secure and reliable methods for submitting requests (per MCDPA requirements):

Web Form: Visit our Privacy Request Portal (URL or link on the Site’s footer titled “Your Privacy Choices” or “Data Request”) to submit a request online.

For security, we may need to verify your identity before completing your request. You do not have to create an account to exercise your rights; however, if you have an account with us, we may ask you to use it to submit a request so we can securely verify your identity. We will respond to your request within 45 days, as required by MCDPA, and may extend by an additional 45 days if reasonably necessary with notice to you. If we cannot fulfill part of your request (due to an exemption or legal requirement), we will explain why.
Opting Out of Marketing Communications: You can unsubscribe from our marketing emails or SMS messages at any time by clicking the “unsubscribe” link in the email, replying “STOP” to an SMS, or contacting us. Please note you will continue to receive administrative messages (e.g., subscription confirmations, legally required notices) even if you opt out of marketing.
Non-Discrimination: We will not deny goods or services, charge different prices, or provide a different level of quality of service if you exercise any of your privacy rights. If you opt out of certain data uses (like targeted advertising), we may still deliver general advertisements, but they will not be personalized to you.
6. Children’s Data
Our Site is not directed to children under the age of 16, and we do not knowingly collect personal data from children under 16. If we learn that we have inadvertently collected personal data from a child under 16 without verifiable parental consent, we will delete that information as soon as possible.
The MCDPA additionally provides special protections for teens aged 13 to 15, requiring opt-in consent to process their data for targeted advertising or sell their data. While we do not knowingly have users in that age range, we do not currently verify ages upon data collection. If you are a parent or guardian and believe your child under 16 has provided personal data to us, please contact us so we can take appropriate action.
We encourage parents and guardians to monitor their children’s internet use and to help enforce this Privacy Policy by instructing their children never to provide personal data on this Site without permission.
7. Data Security
We implement reasonable and appropriate technical and organizational measures to protect the personal data we process against unauthorized access, disclosure, alteration, or destruction. These measures include encryption of payment transactions, access controls to personal information, regular security assessments, and staff training on data protection.
However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal data, we cannot guarantee its absolute security. You share information with us at your own risk, and it is important that you also play a role in keeping your data secure (for example, by choosing strong passwords and keeping them confidential).
In the event of a data breach involving your personal data, we will notify you and/or the appropriate regulatory authorities as required by applicable law.
8. Data Retention
We retain personal data only for as long as necessary to fulfill the purposes for which we collected it, including for the purposes of satisfying legal, accounting, or reporting requirements. For example:

Newsletter sign-up data is retained until you unsubscribe or withdraw consent.

Subscription data is kept for the duration of your subscription and a reasonable period thereafter for record-keeping (usually 7 years for financial records, in line with IRS requirements).

Event submission information is retained for as long as the event remains posted and a short period after for administrative purposes.

Web analytics data is typically retained for 14 months (per Google Analytics default) or as configured in our analytics tools.

Other tracking data for advertising is retained according to our ad partners’ policies (for example, Meta Pixel data follows Facebook’s retention rules).
When we no longer have a legitimate need to retain your personal data, we will securely delete or anonymize it. If deletion or anonymization is not possible (e.g., because personal data is stored in backup archives), we will securely store your personal data and isolate it from further processing until deletion is possible.
9. Third-Party Websites and Services
Our Site may contain links to third-party websites, embedded content, or services (such as social media sharing buttons, external news links, or embedded videos). If you click on a third-party link or interact with third-party content, you will be directed to that third party’s site or service. We do not control and are not responsible for the content or privacy practices of these third parties. We encourage you to review the privacy policies of every website you visit or service you use.
Additionally, features of our Site (like the Event Calendar or newsletters) may be co-branded or offered in partnership with other companies (for instance, a co-sponsored event). If you provide personal data in these contexts, that information may be shared with our partner and subject to their privacy policy as well.
10. Limitation of Liability
Use at Your Own Risk: While we are committed to protecting your privacy, you understand that use of the internet and our Site is solely at your own risk. This Site and our services are provided on an “as is” and “as available” basis. We make no representations or warranties of any kind, express or implied, about the operation or availability of the Site, or the accuracy, security, or completeness of the content or information provided.
No Liability for Certain Actions: To the maximum extent permitted by law, Outlaw Partners, LLC (d/b/a Explore Big Sky) and its affiliates, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profit or revenue, whether incurred directly or indirectly, resulting from:

Your access to or use of (or inability to access/use) the Site;

Any conduct or content of any third party on the Site (including any defamatory, offensive, or illegal conduct of other users or third parties);

Unauthorized access, use, or alteration of your transmissions or personal data;

Any breaches of security beyond our reasonable control.
Liability Cap: In jurisdictions that do not allow the exclusion of certain warranties or limitation of certain liabilities, our liability will be limited to the fullest extent permitted by applicable law. In any event, our total liability for any claims arising under this Privacy Policy or relating to your use of the Site shall not exceed the amount (if any) you have paid to us for services in the last 12 months or one hundred U.S. dollars (USD $100), whichever is greater.
Consumer Rights: Nothing in this section is intended to limit any rights you may have under the MCDPA or other applicable privacy laws. If you are a Montana resident, the MCDPA’s protections (like the right to sue for certain unauthorized data sales, if applicable) apply in addition to the limitations stated here.
11. International Users
Explore Big Sky is based in Montana, USA, and our services are intended for individuals in the United States. If you are accessing the Site from outside the U.S., please be aware that your information may be transferred to, stored, and processed in the United States or other jurisdictions. Data protection laws in these jurisdictions may not be as comprehensive as those in your country. By using our Site or providing us with your information, you consent to the transfer and processing of your information in the U.S. as described in this Privacy Policy.
For users in the European Economic Area or other regions with data transfer restrictions, we will take appropriate measures to ensure an adequate level of data protection when transferring your personal data (such as using Standard Contractual Clauses, if applicable), though our primary focus and compliance obligations revolve around U.S. law (like MCDPA, CCPA, etc.).
12. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, legal requirements, or for other operational, legal, or regulatory reasons. We will post any updates on this page with a new “Last Updated” date. If we make any material changes, we will provide a more prominent notice (such as adding a statement to our homepage or sending you an email notification). We encourage you to review this Privacy Policy periodically to stay informed about how we are protecting your information.
Your continued use of the Site after any modifications to this Privacy Policy constitutes your acceptance of those changes, provided that if you do not agree with any updates or changes, you should cease using the Site.
